The firm can assist with a variety of legal issues regarding matters of its elderly clients including estate planning and asset protection. The firm has extensive experience as it pertains to guardianship proceedings, whether for minors (regarding settlement matters and estate/trust beneficiary matters) or for incapacitated adults. The firm also has experience with regard to Medicaid planning which includes pre-crisis planning as well as crisis planning, the purpose of which is to preserve the client’s assets to the best extent possible in the event the client is required to ultimately apply for Medicaid nursing home benefits. Finally, the firm has extensive experience with respect to representing clients in the Medicaid application process (for nursing home benefits) which includes advising the client and the client’s family members, preparing the application and necessary documents required in the application process as well as filing the application with the appropriate state agency.
